Back the Blue Act Introduced to Strengthen Officer Protections

December 9, 2025

Renewing Our Commitment to Officer Safety

Violence directed at law enforcement has reached levels that no community should accept. By November 30 of this year, 314 officers had been shot in the line of duty and 43 were killed. Sixty two ambush attacks resulted in 83 officers being shot. These numbers reflect a climate where targeting officers is becoming more frequent, more deliberate, and more deadly.

The South Carolina FOP does not wait for tragedy to force action. We push for laws that protect officers before another family gets that life changing knock on the door.

Stronger Federal Consequences for Targeted Violence

The Back the Blue Act addresses gaps that have allowed violent offenders to escape the full weight of federal law. It creates federal penalties for killing or attempting to kill federal judges, federal officers, and state or local officers whose agencies receive federal support. It closes the long recognized loophole that limited capital eligibility only to officers tied to federal investigations or task forces. Officers deserve equal protection regardless of assignment, patch, or jurisdiction.

The bill also strengthens accountability for those who try to evade justice. Interstate flight to avoid prosecution for these crimes becomes a federal offense with mandatory prison time. The legislation limits federal habeas challenges in cases involving murdered public safety officers and prevents violent offenders from manipulating the civil system for financial gain while committing felonies.

Tools That Reflect the Realities Officers Face

Officers must be able to protect themselves in the same unpredictable environments where criminals adapt quickly. The Back the Blue Act expands lawful self defense provisions under LEOSA and aligns federal rules with real world requirements. Qualified officers would be able to enter certain federal facilities when carrying, and magazine capacity limits would no longer expose officers to legal risk in hostile jurisdictions. These updates reflect operational needs that officers have voiced for years.

The Voice of the Fraternal Order of Police

The Fraternal Order of Police has issued its national endorsement of the Back the Blue Act. National President Patrick Yoes highlighted the surge in targeted attacks and emphasized the need for equal federal protections across all levels of law enforcement. His message reflects a reality every officer understands. Violent offenders look for weaknesses in the system, and Congress has a responsibility to eliminate those weaknesses before more lives are lost.

It’s time for Congress to stand with the very people who put their lives on the line to keep us safe. The Back the Blue Act gives federal prosecutors additional tools to hold criminals accountable.

Senator Lindsey Graham

South Carolina’s Unified Voice

Our senators made their positions unmistakably clear. Senator Lindsey Graham stated, “It is time for Congress to stand with the very people who put their lives on the line to keep us safe. The Back the Blue Act gives federal prosecutors additional tools to hold criminals accountable.” Senator Tim Scott added, “Our law enforcement officers put their lives on the line every day to keep Americans safe. The Back the Blue Act strengthens protections for our men and women in blue by ensuring criminals who target them face justice, including the death penalty.”

Their statements reinforce what the South Carolina FOP has long advocated. Officer safety is a priority that demands resolve, not delay.

Our law enforcement officers put their lives on the line every day to keep Americans safe. The Back the Blue Act strengthens protections for our men and women in blue by ensuring criminals who target them face justice, including the death penalty.

Senator Tim Scott

A Clear Path Forward

This legislation strengthens federal penalties, accelerates justice, and gives officers the tools they need to defend themselves and the communities they serve. It is a serious response to a serious threat, and it recognizes the realities every officer faces when they walk out the door.

We appreciate the leadership shown by South Carolina’s senators and their commitment to protecting law enforcement. Their support signals clearly that our state understands the urgency of safeguarding those who protect our communities.
